Welcome to ForgeSpec. These Terms of Service ("Terms") govern your access to and use of ForgeSpec's AI-powered cutting tool recommendation service ("Service"). By using our Service, you agree to these Terms.

1. Acceptance of Terms

By accessing or using ForgeSpec, you confirm that:

• You are at least 18 years old or have reached the age of majority in your jurisdiction
• You are legally authorized to enter into this agreement on behalf of your company (if applicable)
• You will comply with all applicable laws and regulations

2. Description of Service

ForgeSpec provides an AI-powered platform for cutting tool manufacturers and their customers to:

• Receive automated tool recommendations based on machining requirements
• Generate quotes with cutting parameters and pricing
• Access a catalog of cutting tools with technical specifications
• Receive follow-up communications about quotes and recommendations

Important: ForgeSpec provides recommendations based on AI analysis. While we strive for accuracy, these recommendations are provided "as-is" and should be validated by qualified engineers before use in production environments.

3. User Accounts and Registration

Waitlist Registration

• You may join our waitlist by providing your name, email, and company information
• You agree to provide accurate and complete information
• We reserve the right to deny access to the Service at our discretion

Account Security

• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized access to your account
• You are responsible for all activities that occur under your account

4. Acceptable Use

You agree NOT to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Attempt to reverse engineer, decompile, or extract the AI models or algorithms
• Scrape, mine, or harvest data from the Service using automated tools
• Submit false or misleading information to manipulate recommendations
• Use the Service to compete with or harm ForgeSpec or its partners
• Overload or interfere with the Service's infrastructure
• Upload viruses, malware, or other malicious code

5. Intellectual Property

Our Intellectual Property

ForgeSpec and its licensors retain all rights, title, and interest in:

• The Service platform, including all software, AI models, and algorithms
• The ForgeSpec brand, logo, and trademarks
• All content provided through the Service (excluding user-submitted data)
• Tool catalog data, cutting parameters, and recommendation logic

Your Data

• You retain ownership of the machining specifications and project data you submit
• By using the Service, you grant us a license to use your data to provide and improve the Service
• We may use anonymized, aggregated data for analytics and model training

6. Pricing and Payment

Early Access

During the early access period, the Service may be provided at no cost or at promotional pricing. We reserve the right to introduce paid plans in the future with advance notice.

Quotes

Quotes generated by ForgeSpec are estimates based on catalog pricing and may be subject to change. Final pricing is determined by the cutting tool manufacturer or distributor.

7. Disclaimers and Limitation of Liability

No Warranty

THE SERVICE IS PROVIDED "AS-IS" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE:

• That recommendations will be error-free or suitable for your specific application
• That the Service will be available 24/7 without interruption
• That tool catalog data is always current or complete
• That AI-generated cutting parameters will produce optimal results

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORGESPEC SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Machining errors, tool failures, or production delays resulting from our recommendations
• Damages exceeding the fees paid to ForgeSpec in the 12 months preceding the claim

Critical Safety Notice: Cutting tool selection and machining operations involve inherent risks. Always consult qualified engineers and follow industry safety standards. ForgeSpec is not responsible for machining accidents, tool failures, or workplace injuries.

8. Indemnification

You agree to indemnify and hold ForgeSpec harmless from any claims, damages, or expenses (including legal fees) arising from:

• Your use of the Service in violation of these Terms
• Your submission of false, misleading, or infringing content
• Your violation of any third-party rights
• Machining operations conducted based on our recommendations

9. Third-Party Services

ForgeSpec may integrate with third-party services, including:

• Polsia Platform: Autonomous AI infrastructure
• Payment Processors: For future paid plans
• Analytics Providers: For platform monitoring

Use of third-party services is subject to their respective terms and privacy policies.

10. Termination

By You

You may stop using the Service at any time. For account deletion, contact us at support@forgespec.polsia.app

By Us

We may suspend or terminate your access to the Service if:

• You violate these Terms
• Your use poses a security or legal risk
• You engage in fraudulent or abusive behavior
• Required by law or government order

Effect of Termination

• Your right to use the Service ends immediately
• We may delete your account data (subject to legal retention requirements)
• Outstanding quotes may remain accessible for a limited period

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by:

Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

Dispute Resolution

13. Miscellaneous

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and ForgeSpec regarding the Service.
